David Cose, of Mintaro, was summonsed by his wife, Mary Cose, for deserting her and leaving her destitute and without any means of supporting herself and four small children.
Mary Cose, proved that the defendant was bound over to keep the peace towards her on the 9th of January last, and he told her on that day, that she should not return to his house, and she was afraid to do so.
The Bench told complainant that she must return to her home, and the charge could not be sustained, as she had quite deserted her husband.
The Information was dismissed.
