CHADWICK v. MUIR.
Action for £23 15s. 6d., for mason’s work done to defendant’s order by the plaintiff and his men.
The defendant pleaded bad work.
Joseph W. Conley measured the mason’s work done by Mr Chadwick at Muir’s Mintaro Hotel. The work is as good as any other mason’s work done in that part of the colony, and the price in that part of the country he considered fair.
John Perkins examined the outside of the mason’s work at the Mintaro Hotel, and as much of the inside of the house as Mr Muir would allow him to inspect, and was at opinion the work was very well done.
R. Henderson examined the mason’s work at the Mintaro Hotel. The work was very badly done. The walls were neither straight nor plumb.
John Pearce stated that he had seen the mason’s work at the Mintaro Hotel. The work was very badly done.
The testimony of so many practical men, all differing widely in opinion, seemed strange ; however, after hearing all the evidence, the Bench considered the plaintiff entitled to a verdict for £13 1s 6d.
